Zasady korzystania z Aplikacji oraz świadczonych za jej pośrednictwem usług określa Regulamin świadczenia usług drogą elektroniczną, a warunki licencji na oprogramowanie — Umowa Licencyjna Użytkownika Końcowego (EULA). Oba dokumenty dostępne są w Aplikacji oraz pod adresem legal.legit.am. Korzystanie z Aplikacji wymaga akceptacji Regulaminu i EULA; niniejsza Polityka Prywatności ma charakter informacyjny i opisuje przetwarzanie danych zgodnie z art. 13 RODO. Przetwarzanie danych w związku z korzystaniem ze stron internetowych legit.am oraz privacy.legit.am reguluje odrębna Polityka Prywatności — Strony Internetowe. Zasady przeciwdziałania wykorzystywaniu i niegodziwemu traktowaniu dzieci w celach seksualnych, w tym przetwarzania danych z tym związanego, opisują Standardy ochrony dzieci (CSAE).

Podczas skanowania fizycznego Tagu NFC wbudowanego w produkt gromadzimy:
Podanie danych rejestracyjnych (§2.1) jest dobrowolne, ale niezbędne do zawarcia umowy i założenia Konta — bez nich założenie Konta nie jest możliwe. Podanie pozostałych danych jest dobrowolne; odmowa zgody na dostęp do lokalizacji, na analitykę lub na użycie identyfikatorów reklamowych nie ogranicza podstawowych funkcji Aplikacji.
4.1. Tagi NFC wbudowane w produkty umożliwiają przypisanie przedmiotu do Konta, wyświetlenie DPP oraz rejestrację danych odczytu opisanych w §2.3.
4.2. Dane DPP są dostarczane wyłącznie przez producentów lub marki. Legitam P.S.A. pełni w tym zakresie rolę technicznego pośrednika wyświetlającego te informacje i nie ponosi odpowiedzialności za ich treść, dokładność ani aktualność.
4.3. Weryfikacja autentyczności — zastrzeżenie. Legitam P.S.A. dokłada wszelkich starań w zakresie rzetelności weryfikacji autentyczności produktów za pomocą Tagów NFC. Jednocześnie, ze względu na stały postęp technologiczny, Legitam P.S.A. nie może wykluczyć, że w przyszłości mogą wystąpić przypadki fałszywych odczytów (spoofing NFC lub inne formy ingerencji). Legitam P.S.A. nie ponosi odpowiedzialności za szkody wynikłe z takich zdarzeń, o ile dołożyła należytej staranności w zakresie stosowanych zabezpieczeń.
Każdemu Użytkownikowi przypisywany jest wskaźnik AmRank, obliczany na podstawie zweryfikowanej wartości Cyfrowej Szafy oraz poziomu zaangażowania społecznościowego (m.in. tworzenia amLooków i oceniania innych Użytkowników). Algorytm obliczeniowy stanowi tajemnicę handlową i własność intelektualną Legitam P.S.A. Użytkownik może zwrócić się do Legitam P.S.A. z pytaniem o ogólne kryteria wpływające na wskaźnik, nie jest jednak uprawniony do uzyskania szczegółów algorytmu.
Obliczanie AmRank oraz personalizacja feedu stanowią profilowanie w rozumieniu art. 4 pkt 4 RODO. Na ich podstawie nie są podejmowane decyzje wywołujące wobec Użytkownika skutki prawne ani w podobny sposób istotnie na niego wpływające (art. 22 RODO); decyzje moderacyjne podejmowane są z udziałem człowieka (§7.2 Regulaminu). Użytkownik może wnieść sprzeciw wobec profilowania opartego na uzasadnionym interesie (art. 21 RODO).
Dane mogą być udostępniane uprawnionym organom wyłącznie w zakresie wymaganym przez obowiązujące przepisy prawa.
Dane przechowywane są na serwerach AWS. Transfery danych poza EOG zabezpieczone są Standardowymi Klauzulami Umownymi (SCC) zatwierdzonymi przez Komisję Europejską.
Treści publikowane przez Użytkownika (amLooki, komentarze) oraz dane profilu (pseudonim, zdjęcie profilowe, AmRank) są widoczne dla innych Użytkowników Aplikacji w zakresie wynikającym z jej funkcjonalności i ustawień Użytkownika (np. grup odbiorców).
Na podstawie RODO Użytkownikowi przysługują:
Wnioski dotyczące realizacji powyższych praw należy kierować na adres Inspektora Ochrony Danych: dpo@legit.am. Legitam P.S.A. udziela odpowiedzi bez zbędnej zwłoki, nie później niż w terminie 1 miesiąca od otrzymania żądania.
Użytkownikowi przysługuje prawo wniesienia skargi do organu nadzorczego — Prezesa Urzędu Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warszawa.
Zgodnie z art. 77 RODO Użytkownik może również wnieść skargę do organu nadzorczego w państwie członkowskim swojego zwykłego pobytu lub miejsca pracy, w szczególności: we Francji — do Commission Nationale de l'Informatique et des Libertés (CNIL, www.cnil.fr); w Niemczech — do organu ochrony danych właściwego dla kraju związkowego, w którym Użytkownik zamieszkuje, lub do Federalnego Pełnomocnika ds. Ochrony Danych i Wolności Informacji (BfDI, www.bfdi.bund.de); we Włoszech — do Garante per la protezione dei dati personali (www.garanteprivacy.it).
Aplikacja nie jest przeznaczona dla osób poniżej 16. roku życia, zgodnie z wymogiem rejestracji określonym w Regulaminie. Legitam P.S.A. nie gromadzi świadomie danych osób poniżej tego wieku. Dane zgromadzone bez wymaganej zgody lub weryfikacji wieku zostaną niezwłocznie usunięte po powzięciu o tym wiedzy.
Aplikacja korzysta z lokalnego przechowywania danych oraz identyfikatorów urządzenia w zakresie ściśle niezbędnym do świadczenia usługi (utrzymanie sesji, zapamiętywanie preferencji, diagnostyka błędów i bezpieczeństwo), a w pozostałym zakresie — w tym do analityki i użycia identyfikatorów reklamowych — wyłącznie za zgodą Użytkownika, którą można w każdej chwili wycofać. Użytkownik zarządza uprawnieniami Aplikacji (w tym dostępem do lokalizacji i identyfikatorów reklamowych) w ustawieniach systemu iOS / Android. Zasady wykorzystania plików cookies na stronach internetowych Legitam określa odrębna Polityka Cookies.
O istotnych zmianach niniejszej Polityki Legitam P.S.A. informuje z wyprzedzeniem co najmniej 14 dni, za pośrednictwem powiadomienia push, wiadomości e-mail lub komunikatu w Aplikacji po zalogowaniu. Jeżeli zmiana wymaga zgody Użytkownika (np. nowy cel przetwarzania opartego na zgodzie), Legitam P.S.A. poprosi o nią odrębnie.

Relationship to other documents: This Privacy Policy describes the rules for processing the personal data of Users of the Application, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (the "GDPR"). The rules for using the Application and the services provided through it are set out in the Terms of Service, and the license terms for the software are set out in the End-User License Agreement (EULA). Both documents are available in the Application and at legal.legit.am. When a physical NFC Tag embedded in a product is scanned, we collect:
Providing the registration data (§2.1) is voluntary but necessary to conclude the contract and create an Account — without it, an Account cannot be created. Providing other data is voluntary; refusing consent to location access, analytics or the use of advertising identifiers does not restrict the basic features of the Application.
4.1. NFC Tags embedded in products enable an item to be assigned to an Account, the DPP to be displayed, and the scan data described in §2.3 to be recorded.
4.2. DPP data is supplied solely by manufacturers or brands. In this regard, Legitam P.S.A. acts as a technical intermediary displaying this information and bears no responsibility for its content, accuracy, or currency.
4.3. Authenticity verification — disclaimer. Legitam P.S.A. takes all reasonable steps to ensure the reliability of product-authenticity verification via NFC Tags. However, due to continuing technological developments, Legitam P.S.A. cannot rule out that instances of false readings (NFC spoofing or other forms of interference) may occur in the future. Legitam P.S.A. bears no liability for damages arising from such events, provided it has exercised due diligence with respect to the security measures applied.
Every User is assigned an AmRank indicator, calculated based on the verified value of their Digital Closet and their level of community engagement (including creating amLooks and rating other Users). The calculation algorithm constitutes a trade secret and intellectual property of Legitam P.S.A. A User may ask Legitam P.S.A. about the general criteria affecting the indicator but is not entitled to obtain details of the algorithm.
Calculating AmRank and personalising the feed constitute profiling within the meaning of Article 4(4) GDPR. No decisions producing legal effects concerning the User or similarly significantly affecting them are taken on that basis (Article 22 GDPR); moderation decisions are taken with human involvement (§7.2 of the Terms of Service). The User may object to profiling based on legitimate interest (Article 21 GDPR).
Data may be disclosed to authorised authorities solely to the extent required by applicable law.
Data is stored on AWS servers. Transfers of data outside the EEA are safeguarded by Standard Contractual Clauses (SCCs) approved by the European Commission.
Content published by the User (amLooks, comments) and profile data (username, profile picture, AmRank) are visible to other Users of the Application to the extent resulting from its features and the User's settings (e.g., audience groups).
Under the GDPR, the User has the following rights:
Requests concerning the exercise of the above rights should be directed to the Data Protection Officer at dpo@legit.am. Legitam P.S.A. will respond without undue delay, and in any event within one month of receiving the request.
The User has the right to lodge a complaint with the supervisory authority — the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw, Poland.
In accordance with Article 77 GDPR, the User may also lodge a complaint with the supervisory authority of the Member State of their habitual residence or place of work, in particular: in France — the Commission Nationale de l'Informatique et des Libertés (CNIL, www.cnil.fr); in Germany — the data protection authority of the federal state (Land) in which the User resides, or the Federal Commissioner for Data Protection and Freedom of Information (BfDI, www.bfdi.bund.de); in Italy — the Garante per la protezione dei dati personali (www.garanteprivacy.it).
The Application is not intended for persons under the age of 16, in accordance with the registration requirement set out in the Terms of Service. Legitam P.S.A. does not knowingly collect data from persons under this age. Data collected without the required consent or age verification will be deleted promptly upon becoming aware of it.
The Application uses local data storage and device identifiers to the extent strictly necessary to provide the service (maintaining sessions, remembering preferences, error diagnostics and security) and otherwise — including for analytics and the use of advertising identifiers — only with the User's consent, which may be withdrawn at any time. Users manage the Application's permissions (including access to location and advertising identifiers) in their iOS / Android system settings. The use of cookies on Legitam's websites is governed by a separate Cookie Policy.
Legitam P.S.A. will provide at least 14 days' advance notice of any material changes to this Privacy Policy, via a push notification, e-mail, or an in-app message shown after login. Where a change requires the User's consent (e.g., a new purpose of processing based on consent), Legitam P.S.A. will request it separately.

Il conferimento dei dati di registrazione (§2.1) è facoltativo ma necessario per concludere il contratto e creare un Account — in sua assenza non è possibile creare un Account. Il conferimento degli altri dati è facoltativo; il rifiuto del consenso all'accesso alla posizione, all'analisi o all'uso degli identificativi pubblicitari non limita le funzionalità di base dell'Applicazione.
4.1. I Tag NFC integrati nei prodotti consentono di assegnare un articolo a un Account, di visualizzare il DPP e di registrare i dati di scansione descritti al §2.3.
4.2. I dati DPP sono forniti esclusivamente dai produttori o dai marchi. A tale riguardo Legitam P.S.A. agisce come intermediario tecnico che visualizza tali informazioni e non è responsabile del loro contenuto, della loro esattezza o del loro aggiornamento.
4.3. Verifica dell'autenticità — esclusione di responsabilità. Legitam P.S.A. adotta tutte le misure ragionevoli per garantire l'affidabilità della verifica dell'autenticità dei prodotti tramite i Tag NFC. Tuttavia, a causa del continuo sviluppo tecnologico, Legitam P.S.A. non può escludere che in futuro si verifichino casi di letture false (NFC spoofing o altre forme di interferenza). Legitam P.S.A. non è responsabile dei danni derivanti da tali eventi, a condizione di aver usato la dovuta diligenza nelle misure di sicurezza adottate.
A ogni Utente è assegnato un indicatore AmRank, calcolato in base al valore verificato del suo Armadio Digitale e al suo livello di coinvolgimento nella community (tra cui la creazione di amLook e la valutazione di altri Utenti). L'algoritmo di calcolo costituisce segreto commerciale e proprietà intellettuale di Legitam P.S.A. L'Utente può chiedere a Legitam P.S.A. quali siano i criteri generali che incidono sull'indicatore, ma non ha diritto di ottenere i dettagli dell'algoritmo.
Il calcolo dell'AmRank e la personalizzazione del feed costituiscono profilazione ai sensi dell'art. 4, punto 4, del GDPR. Su tale base non vengono adottate decisioni che producono effetti giuridici nei confronti dell'Utente o che incidono in modo analogo significativamente sulla sua persona (art. 22 del GDPR); le decisioni di moderazione sono adottate con intervento umano (§7.2 dei Termini di Servizio). L'Utente può opporsi alla profilazione basata sul legittimo interesse (art. 21 del GDPR).
I dati possono essere comunicati alle autorità competenti esclusivamente nella misura richiesta dalla legge applicabile.
I dati sono conservati sui server AWS. I trasferimenti di dati al di fuori del SEE sono tutelati da clausole contrattuali tipo (SCC) approvate dalla Commissione europea.
I contenuti pubblicati dall'Utente (amLook, commenti) e i dati del profilo (nome utente, immagine del profilo, AmRank) sono visibili agli altri Utenti dell'Applicazione nella misura derivante dalle sue funzionalità e dalle impostazioni dell'Utente (ad es. gruppi di destinatari).
Ai sensi del GDPR, l'Utente dispone dei seguenti diritti:
Le richieste relative all'esercizio dei suddetti diritti devono essere indirizzate al Responsabile della protezione dei dati all'indirizzo dpo@legit.am. Legitam P.S.A. risponderà senza indebito ritardo e comunque entro un mese dal ricevimento della richiesta.
L'Utente ha il diritto di proporre reclamo all'autorità di controllo — il Presidente dell'Ufficio per la protezione dei dati personali, ul. Stawki 2, 00-193 Varsavia, Polonia.
Ai sensi dell'art. 77 del GDPR, l'Utente può inoltre proporre reclamo all'autorità di controllo dello Stato membro in cui risiede abitualmente o lavora, in particolare: in Francia — alla Commission Nationale de l'Informatique et des Libertés (CNIL, www.cnil.fr); in Germania — all'autorità di protezione dei dati del Land in cui risiede l'Utente o al Commissario federale per la protezione dei dati e la libertà d'informazione (BfDI, www.bfdi.bund.de); in Italia — al Garante per la protezione dei dati personali (www.garanteprivacy.it).
L'Applicazione non è destinata a persone di età inferiore a 16 anni, conformemente al requisito di registrazione stabilito nei Termini di Servizio. Legitam P.S.A. non raccoglie consapevolmente dati di persone al di sotto di tale età. I dati raccolti senza il consenso richiesto o senza la verifica dell'età saranno cancellati tempestivamente non appena se ne venga a conoscenza.
L'Applicazione utilizza l'archiviazione locale dei dati e gli identificativi del dispositivo nella misura strettamente necessaria alla fornitura del servizio (mantenimento delle sessioni, memorizzazione delle preferenze, diagnostica degli errori e sicurezza) e, per il resto — anche per l'analisi e l'uso degli identificativi pubblicitari — solo con il consenso dell'Utente, revocabile in qualsiasi momento. Gli Utenti gestiscono le autorizzazioni dell'Applicazione (compreso l'accesso alla posizione e agli identificativi pubblicitari) nelle impostazioni di sistema iOS / Android. L'uso dei cookie sui siti web di Legitam è disciplinato da una separata Cookie Policy.
Legitam P.S.A. comunicherà qualsiasi modifica sostanziale della presente Informativa sulla privacy con almeno 14 giorni di anticipo, tramite notifica push, e-mail o un messaggio nell'Applicazione visualizzato dopo l'accesso. Qualora una modifica richieda il consenso dell'Utente (ad es. una nuova finalità di trattamento basata sul consenso), Legitam P.S.A. lo richiederà separatamente.

Lors de la lecture d'un Tag NFC physique intégré à un produit, nous collectons :
La fourniture des données d'inscription (§2.1) est facultative mais nécessaire à la conclusion du contrat et à la création d'un Compte — sans elles, aucun Compte ne peut être créé. La fourniture des autres données est facultative ; le refus de consentir à l'accès à la localisation, à la mesure d'audience ou à l'utilisation des identifiants publicitaires ne restreint pas les fonctionnalités de base de l'Application.
4.1. Les Tags NFC intégrés aux produits permettent de rattacher un article à un Compte, d'afficher le DPP et d'enregistrer les données de lecture décrites au §2.3.
4.2. Les données DPP sont fournies exclusivement par les fabricants ou les marques. À cet égard, Legitam P.S.A. agit en qualité d'intermédiaire technique affichant ces informations et n'est pas responsable de leur contenu, de leur exactitude ou de leur actualité.
4.3. Vérification de l'authenticité — clause de non-responsabilité. Legitam P.S.A. prend toutes les mesures raisonnables pour garantir la fiabilité de la vérification de l'authenticité des produits au moyen des Tags NFC. Toutefois, en raison de l'évolution constante des technologies, Legitam P.S.A. ne peut exclure que des lectures erronées (NFC spoofing ou autres formes d'interférence) se produisent à l'avenir. Legitam P.S.A. n'est pas responsable des dommages résultant de tels événements, à condition d'avoir fait preuve de la diligence requise quant aux mesures de sécurité appliquées.
Chaque Utilisateur se voit attribuer un indicateur AmRank, calculé sur la base de la valeur vérifiée de son Dressing Numérique et de son niveau d'engagement dans la communauté (notamment la création d'amLooks et l'évaluation d'autres Utilisateurs). L'algorithme de calcul constitue un secret d'affaires et une propriété intellectuelle de Legitam P.S.A. L'Utilisateur peut interroger Legitam P.S.A. sur les critères généraux influant sur l'indicateur, mais n'a pas le droit d'obtenir le détail de l'algorithme.
Le calcul de l'AmRank et la personnalisation du fil constituent un profilage au sens de l'article 4, point 4), du RGPD. Aucune décision produisant des effets juridiques à l'égard de l'Utilisateur ou l'affectant de manière significative de façon similaire n'est prise sur cette base (article 22 du RGPD) ; les décisions de modération sont prises avec une intervention humaine (§7.2 des Conditions d'utilisation). L'Utilisateur peut s'opposer au profilage fondé sur l'intérêt légitime (article 21 du RGPD).
Les données peuvent être communiquées aux autorités habilitées uniquement dans la mesure exigée par la loi applicable.
Les données sont stockées sur des serveurs AWS. Les transferts de données hors de l'EEE sont encadrés par des clauses contractuelles types (CCT) approuvées par la Commission européenne.
Les contenus publiés par l'Utilisateur (amLooks, commentaires) et les données de profil (pseudonyme, photo de profil, AmRank) sont visibles par les autres Utilisateurs de l'Application dans la mesure résultant de ses fonctionnalités et des paramètres de l'Utilisateur (par exemple les groupes de destinataires).
En vertu du RGPD, l'Utilisateur dispose des droits suivants :
Les demandes relatives à l'exercice de ces droits doivent être adressées au Délégué à la protection des données à l'adresse dpo@legit.am. Legitam P.S.A. y répondra dans les meilleurs délais et en tout état de cause dans un délai d'un mois à compter de la réception de la demande.
L'Utilisateur a le droit d'introduire une réclamation auprès de l'autorité de contrôle — le Président de l'Office de protection des données personnelles, ul. Stawki 2, 00-193 Varsovie, Pologne.
Conformément à l'article 77 du RGPD, l'Utilisateur peut également introduire une réclamation auprès de l'autorité de contrôle de l'État membre de sa résidence habituelle ou de son lieu de travail, notamment : en France — la Commission Nationale de l'Informatique et des Libertés (CNIL, www.cnil.fr) ; en Allemagne — l'autorité de protection des données du Land dans lequel l'Utilisateur réside ou le Commissaire fédéral à la protection des données et à la liberté d'information (BfDI, www.bfdi.bund.de) ; en Italie — le Garante per la protezione dei dati personali (www.garanteprivacy.it).
L'Application n'est pas destinée aux personnes âgées de moins de 16 ans, conformément à la condition d'inscription prévue par les Conditions d'utilisation. Legitam P.S.A. ne collecte pas sciemment de données concernant des personnes n'ayant pas atteint cet âge. Les données collectées sans le consentement requis ou sans vérification de l'âge seront supprimées sans délai dès que Legitam P.S.A. en aura connaissance.
L'Application utilise le stockage local de données et des identifiants d'appareil dans la mesure strictement nécessaire à la fourniture du service (maintien des sessions, mémorisation des préférences, diagnostic des erreurs et sécurité) et, pour le reste — y compris pour la mesure d'audience et l'utilisation des identifiants publicitaires — uniquement avec le consentement de l'Utilisateur, qui peut être retiré à tout moment. Les Utilisateurs gèrent les autorisations de l'Application (y compris l'accès à la localisation et aux identifiants publicitaires) dans les paramètres système iOS / Android. L'utilisation de cookies sur les sites web de Legitam est régie par une Politique relative aux cookies distincte.
Legitam P.S.A. informera de toute modification substantielle de la présente Politique de confidentialité au moins 14 jours à l'avance, par notification push, par e-mail ou par un message dans l'Application affiché après la connexion. Lorsqu'une modification requiert le consentement de l'Utilisateur (par exemple une nouvelle finalité de traitement fondée sur le consentement), Legitam P.S.A. le sollicitera séparément.

Verhältnis zu anderen Dokumenten: Diese Datenschutzerklärung beschreibt die Regeln für die Verarbeitung personenbezogener Daten der Nutzer der App gemäß der Verordnung (EU) 2016/679 des Europäischen Parlaments und des Rates (die „DSGVO“). Die Regeln für die Nutzung der App und der über sie erbrachten Dienste sind in den Nutzungsbedingungen festgelegt, die Lizenzbedingungen für die Software im Endbenutzer-Lizenzvertrag (EULA). Beide Dokumente sind in der App und unter legal.legit.am verfügbar. Die Nutzung der App setzt die Annahme der Nutzungsbedingungen und der EULA voraus; diese Datenschutzerklärung hat informativen Charakter und beschreibt die Datenverarbeitung gemäß Art. 13 DSGVO. Die Verarbeitung von Daten im Zusammenhang mit der Nutzung der Websites legit.am und privacy.legit.am regelt eine gesonderte Datenschutzerklärung — Websites. Unser Vorgehen gegen sexuellen Missbrauch und sexuelle Ausbeutung von Kindern, einschließlich der damit verbundenen Datenverarbeitung, ist in den Kinderschutzstandards (CSAE) beschrieben.

Beim Scannen eines in ein Produkt eingebetteten physischen NFC-Tags erheben wir:
Die Angabe der Registrierungsdaten (§2.1) ist freiwillig, für den Vertragsschluss und die Einrichtung eines Kontos jedoch erforderlich — ohne sie kann kein Konto eingerichtet werden. Die Angabe weiterer Daten ist freiwillig; die Verweigerung der Einwilligung in den Standortzugriff, in Analysen oder in die Verwendung von Werbekennungen schränkt die Grundfunktionen der App nicht ein.
4.1. In Produkte eingebettete NFC-Tags ermöglichen es, einen Artikel einem Konto zuzuordnen, den DPP anzuzeigen und die in §2.3 beschriebenen Scandaten zu erfassen.
4.2. DPP-Daten werden ausschließlich von Herstellern oder Marken bereitgestellt. Insoweit handelt die Legitam P.S.A. als technischer Vermittler, der diese Informationen anzeigt, und übernimmt keine Verantwortung für deren Inhalt, Richtigkeit oder Aktualität.
4.3. Echtheitsprüfung — Haftungsausschluss. Die Legitam P.S.A. ergreift alle angemessenen Maßnahmen, um die Zuverlässigkeit der Echtheitsprüfung von Produkten über NFC-Tags sicherzustellen. Aufgrund der fortlaufenden technologischen Entwicklung kann die Legitam P.S.A. jedoch nicht ausschließen, dass künftig Fälle falscher Auslesungen (NFC-Spoofing oder andere Formen der Manipulation) auftreten. Die Legitam P.S.A. haftet nicht für Schäden aus solchen Ereignissen, sofern sie bei den angewandten Sicherheitsmaßnahmen die gebotene Sorgfalt beachtet hat.
Jedem Nutzer wird ein AmRank-Indikator zugewiesen, der auf Grundlage des geprüften Werts seines Digitalen Kleiderschranks und seines Engagements in der Community (u. a. Erstellen von amLooks und Bewerten anderer Nutzer) berechnet wird. Der Berechnungsalgorithmus ist Geschäftsgeheimnis und geistiges Eigentum der Legitam P.S.A. Der Nutzer kann die Legitam P.S.A. nach den allgemeinen Kriterien fragen, die den Indikator beeinflussen, hat jedoch keinen Anspruch auf Einzelheiten des Algorithmus.
Die Berechnung des AmRank und die Personalisierung des Feeds stellen Profiling im Sinne von Art. 4 Nr. 4 DSGVO dar. Auf dieser Grundlage werden keine Entscheidungen getroffen, die dem Nutzer gegenüber rechtliche Wirkung entfalten oder ihn in ähnlicher Weise erheblich beeinträchtigen (Art. 22 DSGVO); Moderationsentscheidungen werden unter Beteiligung eines Menschen getroffen (§7.2 der Nutzungsbedingungen). Der Nutzer kann dem auf berechtigtem Interesse beruhenden Profiling widersprechen (Art. 21 DSGVO).
Daten können an befugte Behörden ausschließlich in dem nach geltendem Recht erforderlichen Umfang weitergegeben werden.
Die Daten werden auf AWS-Servern gespeichert. Übermittlungen von Daten außerhalb des EWR sind durch von der Europäischen Kommission genehmigte Standardvertragsklauseln (SCC) abgesichert.
Vom Nutzer veröffentlichte Inhalte (amLooks, Kommentare) und Profildaten (Benutzername, Profilbild, AmRank) sind für andere Nutzer der App in dem Umfang sichtbar, der sich aus ihren Funktionen und den Einstellungen des Nutzers (z. B. Empfängergruppen) ergibt.
Nach der DSGVO stehen dem Nutzer folgende Rechte zu:
Anträge zur Ausübung der vorstehenden Rechte sind an den Datenschutzbeauftragten unter dpo@legit.am zu richten. Die Legitam P.S.A. antwortet unverzüglich, in jedem Fall innerhalb eines Monats nach Eingang des Antrags.
Der Nutzer hat das Recht, Beschwerde bei der Aufsichtsbehörde einzulegen — dem Präsidenten des Amtes für den Schutz personenbezogener Daten, ul. Stawki 2, 00-193 Warschau, Polen.
Gemäß Art. 77 DSGVO kann der Nutzer außerdem Beschwerde bei der Aufsichtsbehörde des Mitgliedstaats seines gewöhnlichen Aufenthalts oder seines Arbeitsplatzes einlegen, insbesondere: in Frankreich bei der Commission Nationale de l'Informatique et des Libertés (CNIL, www.cnil.fr); in Deutschland bei der Datenschutzaufsichtsbehörde des Bundeslandes, in dem der Nutzer wohnt, oder beim Bundesbeauftragten für den Datenschutz und die Informationsfreiheit (BfDI, www.bfdi.bund.de); in Italien beim Garante per la protezione dei dati personali (www.garanteprivacy.it).
Die App ist gemäß der in den Nutzungsbedingungen festgelegten Registrierungsvoraussetzung nicht für Personen unter 16 Jahren bestimmt. Die Legitam P.S.A. erhebt wissentlich keine Daten von Personen unter diesem Alter. Daten, die ohne die erforderliche Einwilligung oder Altersprüfung erhoben wurden, werden unverzüglich gelöscht, sobald dies bekannt wird.
Die App verwendet lokale Datenspeicherung und Gerätekennungen in dem für die Erbringung des Dienstes unbedingt erforderlichen Umfang (Aufrechterhaltung von Sitzungen, Speichern von Einstellungen, Fehlerdiagnose und Sicherheit) und im Übrigen — einschließlich für Analysen und die Verwendung von Werbekennungen — nur mit Einwilligung des Nutzers, die jederzeit widerrufen werden kann. Die Berechtigungen der App (einschließlich des Zugriffs auf Standort und Werbekennungen) verwalten die Nutzer in den Systemeinstellungen von iOS / Android. Die Verwendung von Cookies auf den Websites von Legitam regelt eine gesonderte Cookie-Richtlinie.
Die Legitam P.S.A. kündigt wesentliche Änderungen dieser Datenschutzerklärung mindestens 14 Tage im Voraus per Push-Benachrichtigung, E-Mail oder einer nach der Anmeldung angezeigten Nachricht in der App an. Erfordert eine Änderung die Einwilligung des Nutzers (z. B. ein neuer einwilligungsbasierter Verarbeitungszweck), holt die Legitam P.S.A. diese gesondert ein.
